The requirements include: 1) Good credit without bankruptcy, foreclosures, or repossessions, and 2) An attorney. In some cases, bonds can be approved without an attorney for strong applicants with prior experience or relevant educational or occupational background. Working with an attorney who specializes in probate can improve approval chances with some bonding companies.

Prepayment is required. Payment is ordinarilly processed directly by the bonding copmany issuing your bond. Most companies accept visa, mastercard, checking account. Some accept paypal and alternative payment methods, please ask.  Most probate bonds are prepaid for 1 year, minor guardianship bonds are prepaid through the age of 18 or high school graduation.

After payment is received, we issue the bond within 24 hours. Upon receipt of your bond, sign the original with ink then it may be filed with court.

Bonds essentially act as a co-signer for the Principal, and no one wants to co-sign on a poor risk. If the Principal has poor credit or there are disputes within the estate, obtaining a bond becomes extremely difficult. While it is possible, the higher costs and prepayment requirements often exceed the expense of hiring an alternative fiduciary. We do not recommend or offer these types of bonds.

If you don’t have an attorney, approval may still be possible if you have a strong background, such as prior probate experience or relevant educational or occupational qualifications. However, working with an attorney is strongly recommended.
